• You authorize EV Credits to access, collect, and aggregate data on your behalf for the purposes of generating carbon credits.
3. Exclusive Rights to Carbon Credits
• By using the Service, you grant EV Credits exclusive rights to aggregate, claim, and sell the carbon credits generated from your EV charging activities.
• EV Credits is the sole entity with the right to claim and benefit from the emission reductions or carbon credits related to your participation, and you will not attempt to claim such credits or transfer rights to another party.
• EV Credits will handle all aspects of verifying and registering the carbon credits with relevant authorities.
4. Carbon Credit Revenue
• You will receive a share of the revenue generated from the sale of carbon credits proportional to your contribution based on the data collected from your EV charger.
5. User Responsibilities
• You are responsible for ensuring that the data you provide or allow EV Credits to access (through apps such as Tesla) is accurate and up to date.
• Any attempt to provide false or fraudulent data may result in termination of your account and forfeiture of any credits or revenues.
6. Intellectual Property
• All content, data, and intellectual property related to the Service, including aggregated data, algorithms, and carbon credit verification methods, are owned exclusively by EV Credits.
7. Termination
• Either party may terminate this agreement at any time. Upon termination, EV Credits retains the exclusive rights to all carbon credits generated during your participation up to the point of termination.
8. Limitation of Liability
• EV Credits is not liable for any indirect, incidental, or consequential damages arising from the use of the Service.
• EV Credits’ total liability under these Terms shall not exceed the amount of revenue generated from your contribution to carbon credits during your use of the Service.
9. Dispute Resolution
• Any disputes arising from these Terms will be governed by the laws of [Insert Jurisdiction], and will be resolved through binding arbitration in [Insert City/State].
